Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Marketing Association LLC, a Florida Limited Liability Company (document number L22000492461), located at 2231 Midnight Pearl Dr, Sarasota, FL 34240, operating at marketingassociation.site.
By engaging our services or accessing our website, you agree to be bound by these Terms.
Services
Marketing Association LLC provides marketing, advertising, consulting, and related services as described in individual service agreements or statements of work.
Client Obligations
- Provide accurate and complete information about your business and marketing objectives
- Respond to requests for approvals, feedback, or information in a timely manner
- Ensure you have all necessary rights and permissions for any materials you provide
- Comply with all applicable laws and regulations
- Pay all fees and charges as agreed in your service agreement
Intellectual Property
Upon full payment of all applicable fees, we grant you a non-exclusive license to use deliverables created for you. We retain ownership of all pre-existing materials, tools, and methodologies used in delivering the services.
Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of the engagement.
Payment Terms
Unless otherwise agreed in writing, invoices are due within 30 days of issuance. Late payments may be subject to a late fee of 1.5% per month. Fees paid are non-refundable unless otherwise stated in writing.
Limitation of Liability
To the maximum extent permitted by applicable law, Marketing Association LLC shall not be liable for any indirect, incidental, or consequential damages. Our total cumulative liability shall not exceed the total fees paid in the three months preceding the claim.
Disclaimer of Warranties
Our services are provided on an "as is" basis. We make no warranties regarding the results of any marketing campaign or the achievement of any specific business objectives.
Governing Law
These Terms shall be governed by the laws of the State of Florida. Any legal proceedings shall be brought in the courts of Sarasota County, Florida.
Changes to These Terms
We may update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
